Please read these Terms of Service ("Terms") carefully before using OutBite.
These Terms govern your access to and use of the OutBite mobile application, our website at outbite.app, and related services (collectively, the "Service") provided by Brunoalm Technologies ("Company," "we," "us," or "our").
By downloading, accessing, or using the Service, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not use the Service.
Interpretation and Definitions
Interpretation
Words with initial capital letters have the meanings defined below. These definitions apply whether the terms appear in singular or plural.
Definitions
For the purposes of these Terms:
- Account means a unique profile created when you sign in to OutBite.
- Affiliate means an entity that controls, is controlled by, or is under common control with a party, where "control" means ownership of 50% or more of the shares, equity interest, or other securities entitled to vote for the election of directors or other managing authority.
- Company means Brunoalm Technologies, Hernán Malo Gonzales, Cuenca, Azuay 010203, Ecuador.
- Device means any device that can access the Service, such as a mobile phone or tablet.
- Service means the OutBite mobile application and website.
- Subscription means a recurring paid plan that unlocks premium features of the Service.
- You means the individual accessing or using the Service, or the company or other legal entity on behalf of which such individual is accessing or using the Service.
Acknowledgment
These Terms constitute a binding agreement between You and the Company regarding your use of the Service.
Your access to and use of the Service is conditioned on your acceptance of and compliance with these Terms and our Privacy Policy. These Terms apply to all visitors, users, and others who access or use the Service.
Age requirement: You represent that you are at least 18 years old. The Service is not intended for individuals under 18, and we do not permit use by minors.
Not a medical service: OutBite helps you discover restaurant meals using publicly available nutrition information and your stated preferences. It does not provide medical care.
What OutBite Does
OutBite helps people discover restaurant meals that match their goals when eating out. Based on your selected goal and preferences, the Service surfaces menu items at nearby restaurant chains and ranks them using our HealthScore system.
OutBite is not:
- A calorie-tracking diary or food logging app
- A medical device, clinical tool, or telehealth service
- A registered dietitian, nutrition counselor, or healthcare provider
- An order-placement or delivery service — we do not place orders on your behalf
OutBite is not affiliated with, endorsed by, or sponsored by any restaurant chain. Restaurant names are used only to identify menu items and locations.
Restaurant Names, Trademarks, and Food Disclaimer
No affiliation or endorsement. OutBite is an independent application. References to restaurants, menu items, chain names, and related trademarks are used solely for identification and informational purposes (for example, to show that a nutrition value corresponds to a specific item at a specific chain). Those names and marks belong to their respective owners. Nothing in the Service implies any partnership, sponsorship, endorsement, or approval by any restaurant, franchise, or food brand.
You order at your own risk. OutBite does not prepare, sell, deliver, or guarantee any food. We do not control restaurant operations, pricing, portion sizes, ingredients, food safety, allergen handling, or availability. Any order you place — at a restaurant, through a delivery app, or otherwise — is solely between you and that restaurant or platform.
No responsibility for meals or outcomes. To the fullest extent permitted by law, the Company is not liable for any illness, allergic reaction, injury, dissatisfaction, or other harm arising from:
- Any meal you order, consume, or receive based on information, scores, or recommendations in the Service
- Incorrect, outdated, or incomplete menu, nutrition, allergen, or availability information
- Differences between displayed information and what a restaurant actually serves
- Actions or omissions of any restaurant, franchisee, employee, or third-party delivery service
Recommendations are not guarantees. Rankings such as HealthScore are algorithmic suggestions based on available nutrition facts and your stated preferences. They are not restaurant endorsements, medical advice, or promises of results.
Your responsibility. You are solely responsible for verifying menu items, ingredients, allergens, customizations, and nutrition information directly with the restaurant before ordering, especially if you have allergies, dietary restrictions, or medical conditions.
Health and Medical Disclaimer
OutBite provides general nutritional information for informational and educational purposes only.
This information is not medical advice, diagnosis, or treatment, and it is not a substitute for professional medical or dietary advice from a qualified healthcare provider or registered dietitian. Always consult a qualified health professional before making significant changes to your diet, especially if you have a medical condition, food allergy, or special dietary needs.
You should always verify item availability, ingredients, allergens, customizations, and nutrition values directly with the restaurant before ordering. Menu items — including Limited Time Offers — may change without notice.
OutBite does not guarantee any health outcome, including weight loss, muscle gain, or improved health markers.
Nutritional Data and HealthScore
Data sources
We source nutrition values from official restaurant publications (PDFs, websites, and other public disclosures), consistent with applicable U.S. menu labeling requirements where relevant. Store location data may include OpenStreetMap contributors (ODbL). See our Privacy Policy for details.
Accuracy
We make reasonable efforts to keep information current, but we do not warrant that any menu item, nutrition value, score, or restaurant detail is complete, accurate, or available at the time you order. In particular:
- Menu items may be discontinued, renamed, or modified without notice
- Seasonal or Limited Time Offer items may not be available at every location
- Customizations, preparation methods, and portion sizes may change actual nutrition values
- Scores such as HealthScore reflect goal-aware ranking based on available nutrition facts — they are not objective measures of health and are not medical recommendations
If you believe information in the app is incorrect, please report it through the app or email [email protected].
Location Services
The Service uses your approximate location only while the app is in use ("When In Use") to find nearby restaurants and rank recommendations. Background location is not required.
By using location-based features, you authorize this use as described in our Privacy Policy. You may deny location permission and, where available, manually select a city instead — some features may be limited without location access.
Accounts
You may sign in with Apple Sign-In or Google Sign-In. You are responsible for maintaining the security of your Device and sign-in credentials.
You agree to provide accurate information and not to impersonate another person or use the Service for unlawful purposes.
We may suspend or terminate your Account if you violate these Terms or use the Service in a way that could harm us, other users, or third parties.
Subscriptions and Billing
OutBite offers a free tier and optional premium Subscriptions processed through the Apple App Store or Google Play Store.
- Pricing: Unless otherwise shown in the app at the time of purchase, subscriptions are offered at approximately $6.99/month or $49.99/year. Prices may vary by region, platform, and promotional offers.
- Free trials: If a free trial is offered, you will be charged when the trial ends unless you cancel before it ends.
- Auto-renewal: Subscriptions automatically renew unless canceled at least 24 hours before the end of the current billing period.
- Billing: Payment is charged to your Apple ID or Google Play account. We do not store your payment card details.
- Manage or cancel: You must manage or cancel Subscriptions through your Apple ID or Google Play account settings. Deleting the app does not cancel your Subscription.
- Restore purchases: Use the "Restore Purchases" option in the app if you reinstall OutBite or switch devices.
Refunds are handled by Apple or Google according to their policies. Contact the relevant app store for billing disputes.
Third-Party Services and Links
The Service may link to or integrate with third-party services, including:
- Apple Sign-In, Google Sign-In, Apple App Store, and Google Play
- Uber Eats, DoorDash, and other ordering platforms
- OpenStreetMap and map providers
When you follow a link to a third-party service, you leave OutBite and that third party's terms and privacy policy apply. We are not responsible for third-party content, pricing, fulfillment, food quality, delivery, or customer service.
If you choose to order through a delivery platform, you do so at your own risk. OutBite does not place orders for you.
Acceptable Use
You agree not to:
- Use the Service for any unlawful purpose
- Reverse engineer, scrape, or attempt to extract source data or models at scale without permission
- Interfere with or disrupt the Service or its infrastructure
- Submit false, misleading, or abusive catalog reports
- Misrepresent your affiliation with OutBite or any restaurant chain
Intellectual Property
The Service, including its design, software, branding, and original content, is owned by the Company or its licensors and is protected by intellectual property laws. You receive a limited, non-exclusive, non-transferable, revocable license to use the Service for personal, non-commercial purposes in accordance with these Terms.
Restaurant nutrition facts we display are factual disclosures from third-party sources. Restaurant names and menu item names are used nominatively for identification.
Termination
We may terminate or suspend your access immediately, without prior notice, if you breach these Terms or if we reasonably believe termination is necessary to protect the Service, our users, or third parties.
Upon termination, your right to use the Service ceases immediately. Provisions that by their nature should survive termination will survive, including disclaimers, limitations of liability, and dispute provisions.
You may stop using the Service at any time. To delete your Account, contact [email protected] as described in our Privacy Policy.
Disclaimer of Warranties
To the maximum extent permitted by applicable law, the Service is provided on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind, whether express, implied, or statutory.
We disclaim all warranties, including implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. We do not warrant that:
- The Service will meet your requirements or produce specific results
- The Service will be uninterrupted, secure, or error-free
- Nutrition information, scores, or recommendations will be accurate, complete, or current
- Any defects will be corrected
Some jurisdictions do not allow exclusion of certain warranties, so some of the above may not apply to you.
Limitation of Liability
To the maximum extent permitted by applicable law, in no event shall the Company, its Affiliates, directors, employees, agents, or licensors be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, goodwill, or other intangible losses, arising from:
- Your use of or inability to use the Service
- Any meal ordered, consumed, or delivered based on information in the Service
- Unauthorized access to or alteration of your transmissions or data
- Any third-party conduct or content linked from the Service
To the maximum extent permitted by law, our total liability for any claim arising out of or relating to the Service shall not exceed the greater of (a) the amount you paid us through the Service in the twelve (12) months before the claim or (b) USD $100.
Some jurisdictions do not allow limitation of liability for personal injury or certain damages, so some limits may not apply.
Indemnification
You agree to defend, indemnify, and hold harmless the Company and its Affiliates, officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising from your use of the Service, your violation of these Terms, or your violation of any rights of a third party.
Governing Law
These Terms are governed by the laws of Ecuador, excluding its conflict-of-law rules.
Your use of the Service may also be subject to other local, state, national, or international laws, including the laws of the country where you reside.
Dispute Resolution

For Users in the European Union
If you are a consumer in the European Union, you will benefit from any mandatory provisions of the law of your country of residence. Nothing in these Terms affects your statutory rights as a consumer.
United States Legal Compliance
You represent and warrant that:
- You are not located in a country subject to a U.S. government embargo or designated as a "terrorist supporting" country; and
- You are not listed on any U.S. government list of prohibited or restricted parties.
Severability and Waiver
If any provision of these Terms is held invalid or unenforceable, the remaining provisions will remain in effect. Failure to enforce any right or provision shall not constitute a waiver of such right or provision.
Changes to These Terms
We may modify these Terms at any time. If we make material changes, we will provide reasonable notice before the new terms take effect (for example, by posting the updated Terms on this page, in the app, or by email).
By continuing to access or use the Service after the revised Terms become effective, you agree to be bound by the revised Terms. If you do not agree, stop using the Service.
